This Volunteer Agreement (this “Agreement”) is entered into on the date below by the following: Bridges to Science, a 501(c)(3) nonprofit organization (the “Organization”); a volunteer (the “Volunteer” or “you”); and If the Volunteer is younger than 18 years old, the Volunteer’s undersigned parent or legal guardian (the “Guardian”).
Nature of Agreement. The position of Volunteer at the Organization is a volunteer position. This means that you will perform all duties on a voluntary basis, and you will not receive remuneration or payment for your work. Neither the Organization nor the Volunteer intend to create any employment or contractual relationship, and you will not be an employee, independent contractor or consultant at the Organization. You should not have any out-of-pocket expenses related to your position with the Organization, but if you do, please discuss them in advance with your supervisor. Absent any specific agreement to the contrary, the Organization will not reimburse any of your expenses.
Supervisor. Your supervisor at the Organization will be [Rosa Aristy]. If you have any questions regarding your duties or your role in the Organization, please contact this person at the following email: info@bridgestoscience.org or phone number: (832) 736-4799. You will provide your supervisor with your current phone number and email address, and ensure that the Organization’s contact information for you remains up to date.
Volunteer Role. Your specific volunteer role for the Organization is as selected above. In addition to the duties laid out in this Agreement, your specific responsibilities are laid out in the job description provided by Bridges to Science.
Expectations. The Organization expects you to:
-Support and uphold the Organization’s objectives
-Only undertake duties you’re authorized to carry out and always operate under the direction and supervision of nominated staff or and obey reasonable directions and instructions
-Understand and comply with the law and with the Organization’s policies and procedures
-Behave professionally and courteously to all staff and students and do not engage in any improper or inappropriate behavior
Child Protection Training. Texas law requires that any individual who suspects that a child is being neglected or abused must report it to the state. The Organization is dedicated to improving the lives of the students it serves, and protecting their welfare is vital. In light of that, by signing below, the Volunteer certifies that they have reviewed 1) The free training guide for childcare professionals offered by the Texas Department of Family and 2) Protective Services and the Sexual Abuse Prevention for Children and Teens, available here: 1)https://www.dfps.texas.gov/Training/Reporting/default.asp and 2)https://drive.google.com/file/d/1ftn9tdgr2P0I6GpcImEW_V1TbUCUSXeb/view?usp=sharing. In the event that, in the course of volunteering for the Organization, you have suspicions that one or more child participants in the Organization’s programming is being abused or neglected, you will also report these suspicions to your supervisor immediately.
Infractions. Consequences for any breach of this Agreement include, but are not limited to:
a) Discussion of the inappropriate actions with your supervisor for clarification of the policy
b) Reassignment, suspension, or termination of your relationship with the Organization
c) Notification of incident to the appropriate law enforcement agency
Media. Volunteers will not post any photos, videos or writings on the internet that are related to the Organization, including without limitation on any social media website or app. This does not include sharing or linking media content that originated from the Organization. Volunteer hereby grants to the Organization, and its authorized agents, vendors, officers, directors, employees, licensees, affiliates, successors, and assigns the right and license to use, reproduce, display, perform, edit, create derivative works of, and distribute, in whole or in part, any photographs and/or recordings taken of Volunteer or by Volunteer during activities sponsored by the Organization.
Background Check. Before commencing any duties for the Organization, Volunteer will complete and submit a background check form at the following link: https://www.ministryopportunities.org/bridgestoscience. Any fee paid by the Volunteer in connection with such a background check may be reimbursed by the Organization at the Volunteer’s option. The Organization may, but will not be required to, conduct any other background check on Volunteer it deems appropriate, which may include a review of sex offender registries, child abuse, and criminal activity records. Your position as a volunteer with the Organization is specifically conditioned upon the results of these background checks, and you will not be permitted to volunteer if the Organization deems any of these results to be incompatible with its mission.
Termination. The Organization expects that you will make every effort to fulfill your volunteer commitment and perform the duties described on Attachment 1. In the event that you have an unforeseen change in circumstances, you will inform your supervisor as soon as possible. Notwithstanding the foregoing, the Organization may reassign you or terminate its relationship with you at any time, with or without cause.
Premises Rules and Regulations. Your volunteer duties may be carried out in a facility that is owned or leased by a party other than the Organization. You will only enter such a facility at pre-authorized times, and will use such facility only in the manner permitted by the facility host. You will comply with all policies, rules, and regulations of the facility and will cause your students to do the same.
Confidentiality. Volunteer will protect and hold in strict confidence, and will not undertake, cause or permit any unauthorized use, disclosure, reproduction, publication, distribution or public exhibition of any of the following types of information: (i) personal information of any student or other individual to which Volunteer is afforded access in the course of Volunteer’s duties, (ii) any information that is identified by the Organization or any of its partners, collaborators, or service providers as confidential or non-public information. This Section 11 will survive any termination of this Agreement. Miscellaneous. Subject to the other provisions hereof, no failure on the part of a party to exercise and no delay in exercising any right hereunder will operate as a waiver thereof, nor will any single or partial exercise by a party of any right hereunder preclude any other or further right of exercise thereof or the exercise of any other right. If any clause or provision of this Agreement is illegal, invalid or unenforceable under any present or future Law, the remainder of this Agreement will not be affected thereby. It is the intention of the parties that if any such provision is held to be illegal, invalid or unenforceable, there will be added in lieu thereof a provision as similar in terms to such provisions as is possible to make such provision legal, valid and enforceable. The obligations of Volunteer in this Agreement are personal and may not be assigned. This Agreement may be executed in two or more counterparts (including electronically), each of which the parties will treat as an original but all of which together will constitute one and the same instrument. This Agreement is the complete and exclusive agreement and understanding of the parties in respect of the subject matter hereof and thereof and expressly supersede all prior understandings, agreements, or representations by or among the parties, written or oral, with respect thereto. No amendment or modification of any provision of this Agreement will be valid, unless the same is in writing and signed by all parties.
Release of Liability and Waiver
In order to participate in a program offered by Bridges to Science, the parent or legal guardian of each participating student must submit this signed Release of Liability and Waiver and Parental or Legal Guardian Permission (this “Waiver”).
RELEASE AND CONSENT
I am the parent or other legal guardian of the above named minor(s) (such minor(s), the “Participant”). I authorize the Participant to participate in the programs offered by Bridges to Science (“B2S”), including, for the avoidance doubt, use of online forums and third-party platforms, chat rooms, and other forms of communication in connection therewith (collectively, the “Programs”) and acknowledge that the Participant’s participation is entirely voluntary.
I acknowledge the educational benefits accruing to the Participant through the participation in the Programs and understand the activities such participation might entail include, without limitation, videoconferencing, communicating via online forums, and attending in-person meetings. I understand that the nature and purpose of the Programs in which the Participant will be participating are primarily to provide an educational environment with the goal of engaging and/or encouraging the Participant to develop an interest in mathematics and/or other sciences, as applicable.
Although B2S hopes that no person is ever injured or hurt, injuries are a possibility of participation in the Programs. The risk of injuries is a risk that the Participant and I voluntarily agree to assume in exchange for the privilege of registering for and participating in the Programs. The Participant and I understand and agree that this risk is not a risk that B2S assumes and that B2S is not responsible for any injuries to the Participant or the Participant’s property. Accordingly, I voluntarily release, discharge, and waive the right, on behalf of the Participant, myself and the Participant’s other legal guardians, to make a claim against B2S or its directors, managers, officers, employees, equity holders, volunteers, affiliates, partner organizations, partner institution, agents, those responsible for the facilities being used by B2S, and all persons acting by, through, under, or in concert with B2S (collectively, the “Released Parties”) for any and all losses, demands, sickness (including without limitation COVID-19), claims, suits, causes of action, liability, costs, expenses, property damage, judgments, and expenses of any nature whether arising in equity, at common law, or by statute, under the law of contracts, torts, or property, for personal injury (including without limitation emotional distress), arising in favor of the Participant, myself and the other legal guardians of the Participant, or anyone claiming through us based upon, in connection with, relating to or arising out of, directly or indirectly, the Participant’s participation in the Programs (collectively, “Claims”) EVEN IF ANY SUCH CLAIMS ARE DUE TO THE RELEASED PARTIES’ SOLE OR JOINT NEGLIGENCE, STRICT LIABILITY WITHOUT REGARD TO FAULT, VIOLATION OF STATUTE, OR OTHER FAULT, INCLUDING ANY NEGLIGENT ACT, OMISSION, OR INTENTIONAL ACT INTENDED TO PROMOTE THE PARTICIPANT’S SAFETY OR WELL-BEING.
On behalf of the Participant, I hereby give permission to the Released Parties to obtain emergency medical treatment for the Participant, at my expense, if any Released Party deems in its sole discretion that such emergency medical treatment is necessary.
I acknowledge and agree (for myself and the Participant) that any photos, videos, pictorial images, voice recordings, or quotations including those of the Participant taken or created by any Released Party (including without limitation any taken by any photographer or videographer paid by or volunteering for any Released Party) during or relating to any of the Programs are the sole property of B2S and may be used in future publications, web pages, promotions, advertisements and exhibits of B2S (or any other person authorized to use such images by B2S) without the need of any additional permission from or consideration to the Participant, myself or the other legal guardians of the Participant. I release and waive for myself, the Participant, the other legal guardians of the Participant and anyone claiming through us, all claims based on the right of privacy, right of publicity, moral rights, or any other intellectual property rights related to the rights granted herein to B2S.
I understand that B2S may suspend or terminate the Participant’s access to the Programs in its sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the terms hereof. This Waiver is effective for one year (the “Term”).
Any technology or materials provided is provided without warranty or guarantee of functionality. I agree that I am responsible for any issues regarding maintenance, upkeep, failures, or accidents occurring after receiving my technology. Bridges to Science and its partner Canary Academy Online are not liable for any malfunctions or accidents after I receive my technology from them. It is recommended I obtain warranty, if possible.
DISCLAIMER OF WARRANTIES: I UNDERSTAND AND EXPRESSLY AGREE TO ACCEPT THAT THE WEBSITE, THE ONLINE CLASSES, AND THE IN PERSON PROGRAMS ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND.
